By accessing our website, booking any tour, or using any of our services, you (“Traveler”, “Customer”, “Guest”, or “Client”) acknowledge that you have read, understood, and agreed to be legally bound by these Terms & Conditions.

These Terms govern all bookings, travel packages, customized tours, transportation, hotel reservations, website usage, and all services provided by SAKHER BHRAMAN TOUR & TRAVELS.

If you do not agree with these Terms & Conditions, you must not use our website or book any of our services.

2. Definitions

For the purpose of these Terms & Conditions:

Company

Means SAKHER BHRAMAN TOUR & TRAVELS.

Traveler

Means any individual booking or participating in any tour or travel service provided by the Company.

Booking

Means any reservation made through our website, phone call, email, WhatsApp, office visit, or any authorized representative.

Tour

Means any domestic, international, group, customized, pilgrimage, adventure, leisure, or other travel package offered by the Company.

Supplier

Means any third-party provider including hotels, airlines, railways, transport operators, sightseeing operators, guides, restaurants, or any other service provider engaged for the tour.


3. Acceptance of Terms

By making a booking with SAKHER BHRAMAN TOUR & TRAVELS, you confirm that:

  • You are at least 18 years of age or are booking through a parent or legal guardian.
  • All information provided by you is true, complete, and accurate.
  • You have carefully read these Terms & Conditions before making any payment.
  • You agree to comply with all Company policies.
  • You understand that your booking constitutes a legally binding agreement between you and the Company.

4. Services Offered

The Company currently provides:

  • Domestic Tour Packages
  • Selected International Tours (including Nepal and Bhutan)
  • Group Tours
  • Customized Tours
  • Hotel Reservations
  • Transportation Arrangements
  • Sightseeing Tours
  • Pilgrimage Tours
  • Holiday Packages
  • Tour Planning & Consultation

Certain services are arranged through trusted third-party suppliers.


5. Booking Process

A booking is considered confirmed only after:

  • Submission of required traveler information.
  • Payment of the applicable booking advance.
  • Confirmation issued by the Company through email, WhatsApp, SMS, invoice, or booking confirmation document.

The Company reserves the right to refuse or cancel any booking without assigning any reason if circumstances require.


6. Booking Amount

Unless otherwise specified:

  • A minimum 30% advance payment is required to confirm a booking.
  • The remaining balance must be paid at least two (2) weeks before the scheduled departure date.
  • Failure to complete the payment within the specified timeline may result in automatic cancellation of the booking.
  • The Company shall not be liable for any resulting loss, cancellation charges, or additional expenses due to non-payment.

7. Accepted Payment Methods

Currently, payments are accepted through:

  • UPI
  • Bank Transfer
  • Cash Payment

At present, the Company does not accept:

  • Credit Cards
  • Debit Cards
  • Online Payment Gateway Payments
  • EMI Facilities

The Company reserves the right to introduce or discontinue any payment method without prior notice.


8. Pricing Policy

All prices published on the website, brochures, advertisements, or social media are subject to change without prior notice.

Prices may change due to:

  • Hotel rate revisions
  • Airline fare changes
  • Railway fare revisions
  • Fuel price increases
  • Government taxes
  • Currency fluctuations
  • Seasonal demand
  • Supplier price changes
  • Natural disasters
  • Force Majeure events

Only bookings confirmed with the required advance payment are eligible for the quoted package price unless otherwise specified.


9. Tour Inclusions & Exclusions

Every tour package includes only the services specifically mentioned in the respective itinerary.

Any service not expressly included shall be considered excluded.

Examples of excluded items may include:

  • Personal expenses
  • Laundry
  • Telephone charges
  • Room service
  • Medical expenses
  • Insurance
  • Visa charges
  • Entry tickets (unless specified)
  • Camera fees
  • Adventure activities
  • Porter charges
  • Tips & gratuities
  • Meals not listed in the itinerary
  • Personal shopping
  • Additional transportation requested by the traveler

10. Traveler Information

The traveler is solely responsible for providing accurate and complete information, including but not limited to:

  • Full Name
  • Date of Birth
  • Mobile Number
  • Email Address
  • Residential Address
  • Government-issued Identification
  • Passport Details (if applicable)
  • Visa Details (if applicable)
  • Emergency Contact Information

Providing incorrect information may result in booking cancellation, denial of travel, or additional costs, for which the Company shall not be held responsible.


11. Travel Documents

Travelers must possess all valid travel documents required for the destination.

Accepted identity documents may include:

  • Aadhaar Card
  • Voter ID Card
  • Passport
  • Any other government-approved identification where applicable

For international tours, travelers are responsible for ensuring that their passport remains valid in accordance with the destination country’s immigration requirements.

Failure to carry valid travel documents may result in denied boarding or denied entry, and the Company shall not be responsible for any resulting loss.


12. Visa Requirements

For international tours:

  • Visa approval is subject to the respective embassy or government authority.
  • The Company may assist in the visa application process where applicable.
  • Visa approval or rejection is beyond the Company’s control.
  • Visa fees, documentation requirements, and processing timelines are governed by the relevant authorities.
  • The Company shall not be liable for losses arising from visa refusal, delay, or cancellation.

13. Traveler Responsibilities

All travelers are expected to act responsibly and cooperate with the Company, tour managers, guides, drivers, hotel staff, and fellow travelers throughout the tour.

By booking a tour with SAKHER BHRAMAN TOUR & TRAVELS, you agree to:

  • Provide complete and accurate personal information.
  • Carry valid identification and travel documents at all times.
  • Arrive at the designated meeting point on time.
  • Follow the instructions of the Tour Manager or Tour Leader.
  • Respect local laws, customs, traditions, and cultural practices.
  • Respect fellow travelers and maintain appropriate behavior.
  • Take reasonable care of your personal belongings.

The Company reserves the right to refuse service or terminate the participation of any traveler whose conduct is considered unsafe, abusive, disruptive, illegal, or harmful to other travelers or staff.


14. Late Arrival & Missed Departure

Travelers are solely responsible for reaching the designated departure point on time.

The Company shall not be responsible for:

  • Missed buses
  • Missed trains
  • Missed flights
  • Missed sightseeing
  • Missed hotel check-ins
  • Additional transportation costs
  • Accommodation expenses resulting from the traveler’s delay

If a traveler fails to join the tour on time, the booking may be treated as a No-Show, and the applicable cancellation policy shall apply.


15. Illegal Activities

The Company maintains a strict zero-tolerance policy toward unlawful conduct.

Any traveler involved in:

  • Criminal activity
  • Drug possession or trafficking
  • Physical violence
  • Theft
  • Harassment
  • Vandalism
  • Public misconduct
  • Any activity prohibited under the laws of India or the destination country

shall be solely responsible for the legal consequences.

The Company reserves the right to immediately terminate the traveler’s participation in the tour without any refund. Any fines, penalties, legal expenses, or damages arising from such conduct shall be borne entirely by the traveler.


16. Health & Medical Requirements

Travelers are responsible for ensuring that they are medically fit to participate in the selected tour.

For specific tours, such as Amarnath Yatra, travelers may be required to submit a valid health or fitness certificate as mandated by the relevant authorities.

Travelers must inform the Company in advance about:

  • Serious medical conditions
  • Physical disabilities
  • Pregnancy (where applicable)
  • Allergies
  • Special dietary requirements
  • Any condition that may affect the tour

The Company reserves the right to decline participation if a traveler’s medical condition poses a risk to themselves or others.


17. Travel Insurance

Travel insurance is currently not mandatory for booking a tour with the Company.

However, the Company strongly recommends that travelers obtain comprehensive travel insurance covering:

  • Medical emergencies
  • Accidents
  • Trip cancellation
  • Personal belongings
  • Flight delays
  • Baggage loss
  • Natural disasters

The Company shall not be liable for losses that could have been covered under a travel insurance policy.


18. Company Responsibilities

The Company will make reasonable efforts to provide the services included in the confirmed itinerary, including:

  • Hotel accommodation
  • Ground transportation
  • Meals (where included)
  • Sightseeing
  • Tour coordination
  • Tour management

The Company is committed to delivering the booked services with professionalism and reasonable care.


19. Third-Party Suppliers

Certain services are provided by independent third-party suppliers, including but not limited to:

  • Hotels
  • Transport operators
  • Airlines
  • Indian Railways
  • Local sightseeing operators
  • Adventure activity providers

While the Company carefully selects its suppliers, it does not own or directly control these service providers.

The Company shall not be responsible for:

  • Service delays
  • Operational failures
  • Supplier negligence
  • Hotel management decisions
  • Airline schedule changes
  • Railway delays
  • Third-party service interruptions

However, the Company will make reasonable efforts to assist travelers in resolving issues whenever possible.


20. Hotels & Accommodation

Accommodation will be provided according to the package booked.

Depending on availability, travelers may be accommodated in:

  • Standard Hotels
  • Deluxe Hotels
  • 3-Star Hotels

The Company reserves the right to substitute accommodation with another hotel of a similar category due to:

  • Overbooking
  • Operational issues
  • Safety concerns
  • Natural disasters
  • Government restrictions
  • Supplier-related circumstances

Such substitutions shall not constitute a breach of contract.


21. Transportation

Transportation arrangements may include:

  • 4-Seater Vehicles
  • 7-Seater Vehicles
  • 16-Seater Vehicles
  • Other suitable vehicles depending on group size

Vehicle allocation is based on operational requirements and package specifications.

Air-conditioned vehicles may not always be available. Availability depends on:

  • Weather conditions
  • Destination
  • Vehicle availability
  • Customer-selected package

Seat allocation is generally on a random basis unless specifically agreed otherwise.


22. Itinerary Changes

Tour itineraries are planned in advance; however, circumstances beyond the Company’s control may require modifications.

The Company reserves the right to:

  • Change sightseeing order
  • Modify travel routes
  • Replace hotels
  • Alter transportation
  • Adjust departure times
  • Cancel specific activities

Such changes may occur due to:

  • Weather conditions
  • Traffic
  • Road closures
  • Government restrictions
  • Local regulations
  • Safety concerns
  • Operational requirements

Whenever possible, suitable alternatives will be provided.


23. Tour Rescheduling

The Company may reschedule a tour due to:

  • Insufficient number of participants
  • Natural disasters
  • Government restrictions
  • Operational challenges
  • Safety concerns

Travelers may also request a reschedule, subject to:

  • Availability
  • Supplier approval
  • Applicable charges
  • Company approval

Rescheduling is not guaranteed and will be handled on a case-by-case basis.


24. Minimum Group Size

Some group departures require a minimum number of participants.

If the required minimum is not met, the Company may:

  • Cancel the departure
  • Reschedule the tour
  • Offer an alternative departure
  • Offer a customized package (subject to revised pricing)

Travelers will be informed as early as reasonably possible.


25. Additional Expenses

Unless specifically included in the package, travelers shall bear all additional expenses, including but not limited to:

  • Personal shopping
  • Medical expenses
  • Emergency transportation
  • Room upgrades
  • Additional meals
  • Adventure activities
  • Personal entertainment
  • Laundry
  • Telephone charges
  • Porter services
  • Tips
  • Any cost arising from personal requests

Any extra expense incurred due to the traveler’s personal actions, delays, or decisions shall be solely borne by the traveler.

26. Force Majeure

The Company shall not be held liable for any failure, delay, cancellation, interruption, or modification of any tour or travel service arising from events beyond its reasonable control (“Force Majeure Events”).

Such events include, but are not limited to:

  • Floods
  • Earthquakes
  • Landslides
  • Cyclones or severe weather
  • Pandemic or epidemic outbreaks
  • Government restrictions or advisories
  • Political unrest
  • Civil disturbances
  • Curfews
  • War or military actions
  • Terrorist activities
  • Strikes or labor disputes
  • Airline or railway operational disruptions
  • Road blockages
  • Natural calamities
  • Any unforeseen emergency affecting travel operations

In such situations, the Company may, at its sole discretion:

  • Reschedule the tour.
  • Modify the itinerary.
  • Substitute services with comparable alternatives where feasible.
  • Cancel the tour if continuing it is unsafe or impractical.

Any refunds or credits, where applicable, will depend on the refund policies of the respective third-party suppliers.


27. Website Usage

By using the Company’s website, you agree that you will not:

  • Attempt unauthorized access to our systems or data.
  • Upload viruses, malware, or harmful code.

29. Photography & Promotional Content

During tours, photographs and videos may be taken by the Company for documentation and promotional purposes.

By participating in a tour, travelers consent to the use of such photographs or videos on:

  • The Company’s website
  • Social media platforms
  • Printed promotional materials
  • Advertisements
  • Marketing campaigns

If a traveler does not wish to appear in promotional content, they should notify the Company in writing before the tour begins. The Company will make reasonable efforts to honor such requests where practicable.


30. Pricing Errors

Although the Company strives to ensure that all prices displayed on the website and promotional materials are accurate, inadvertent errors may occur.

If an obvious pricing error is identified after a booking request but before confirmation, the Company reserves the right to:

  • Correct the error,
  • Offer the traveler the option to proceed at the corrected price, or
  • Cancel the booking and refund any amount already paid.

31. Limitation of Liability

To the maximum extent permitted by applicable law, SAKHER BHRAMAN TOUR & TRAVELS shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to:

  • Personal decisions of the traveler,
  • Missed departures,
  • Loss of luggage or personal belongings,
  • Illness or injury not caused by the Company’s negligence,
  • Flight or train delays or cancellations,
  • Hotel operational issues,
  • Third-party supplier failures,
  • Government actions,
  • Visa refusal,
  • Weather conditions,
  • Force Majeure Events.

The Company’s liability, if any, shall in no event exceed the total amount actually paid by the traveler for the specific booking giving rise to the claim, except where otherwise required by applicable law.


32. Indemnification

The traveler agrees to indemnify, defend, and hold harmless SAKHER BHRAMAN TOUR & TRAVELS, its directors, employees, representatives, tour managers, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of:

  • Violation of these Terms & Conditions,
  • Breach of applicable laws,
  • Negligent or intentional misconduct,
  • Damage to third-party property,
  • Injury caused to other travelers or staff due to the traveler’s actions.

33. Amendments to These Terms

The Company reserves the right to modify, update, or replace these Terms & Conditions at any time without prior notice.

The latest version will always be published on the official website.

Continued use of the Company’s services after such updates constitutes acceptance of the revised Terms.


34. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of India.

Nothing in these Terms shall limit any mandatory rights available to consumers under applicable Indian law.


35. Jurisdiction

Any dispute, claim, or legal proceeding arising out of or relating to these Terms, the website, or any booking made with the Company shall be subject to the exclusive jurisdiction of the competent courts located in Kolkata, West Bengal, India.

The Company may also attempt to resolve disputes amicably before initiating legal proceedings.


36. Dispute Resolution

If a traveler has any complaint regarding any service, they are encouraged to contact the Company promptly so that the matter can be reviewed and, where possible, resolved amicably.

If the dispute cannot be resolved through mutual discussion, either party may pursue appropriate legal remedies before the competent courts in Kolkata, West Bengal, in accordance with applicable Indian law.


37. Severability

If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.


38. Waiver

Failure or delay by the Company in exercising any right or remedy under these Terms shall not constitute a waiver of that right or remedy.

Any waiver shall be effective only if made in writing by the Company.


39. Entire Agreement

These Terms & Conditions, together with any booking confirmation, itinerary, invoice, refund policy, privacy policy, and other policies published by the Company, constitute the entire agreement between the traveler and SAKHER BHRAMAN TOUR & TRAVELS concerning the services provided.
